Liability Waiver

1. Introduction

This Liability Waiver ("Waiver") is executed by Users ("Users") of the Yacht Away Greece platform ("Platform"), operated by Yacht Away Greece ("Company"). By using the Platform and participating in yacht rental activities, Users acknowledge and agree to the terms set forth in this Waiver.

2. Assumption of Risk

Users acknowledge that yacht rental and related activities involve inherent risks, including but not limited to risks of injury, property damage, and loss. Users voluntarily assume all risks associated with these activities, whether known or unknown.

3. Waiver and Release

To the fullest extent permitted by law, Users hereby waive, release, and discharge the Company, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, or causes of action arising out of or related to their use of the Platform or participation in yacht rental activities, including but not limited to claims for personal injury, property damage, or wrongful death.

4. Indemnification

Users agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of or related to their breach of this Waiver or their negligent or wrongful conduct while using the Platform or participating in yacht rental activities.

5. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Platform or participation in yacht rental activities, even if the Company has been advised of the possibility of such damages.

6. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. Users agree that any legal action or proceeding arising out of or related to this Waiver shall be brought exclusively in the courts of Greece.

7. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Entire Agreement

This Waiver constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements or understandings, whether written or oral.
