Owner Agreement

1. Introduction

This Owner Agreement ("Agreement") is entered into by and between Yacht Away Greece ("Company") and the yacht owner ("Owner") who lists their vessel for rental on the Yacht Away Greece platform ("Platform"). By listing a yacht, the Owner agrees to comply with the terms and conditions set forth in this Agreement.

2. Eligibility and Listing Requirements

Ownership Verification: The Owner must provide proof of ownership and any necessary licenses or documentation required to legally rent out the vessel.
Compliance: The Owner must ensure that the yacht complies with all applicable maritime laws and regulations, including safety and maintenance standards.

3. Commission and Fees

Commission Structure: The Company shall receive a commission based on the total rental fee for each booking, as specified in the Platform's fee schedule.
Payment of Fees: Fees are deducted from the rental proceeds before disbursement to the Owner.

4. Owner Responsibilities

Maintenance and Safety: The Owner is responsible for maintaining the yacht in a safe and operable condition, equipped with all necessary safety gear and equipment.
Accurate Listings: The Owner must provide accurate and truthful information regarding the yacht's specifications, availability, and rental terms.
Communication: The Owner must respond promptly to inquiries and booking requests from potential Renters.

5. Cancellations and Penalties

Owner Cancellations: Owners who cancel confirmed bookings may be subject to penalties, including financial penalties or suspension from the Platform, as detailed in the Platform's cancellation policy.
Force Majeure: The Owner shall not be penalized for cancellations due to Force Majeure Events, provided they notify the Company and Renter promptly.

6. Indemnification

The Owner agrees to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising out of or related to the Owner's breach of this Agreement or the rental of the yacht.

7. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the Owner's use of the Platform or the rental of the yacht.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. Any disputes arising out of or related to this Agreement shall be resolved exclusively in the courts of Greece.

9. Amendments

The Company reserves the right to amend this Agreement at any time. Changes will be effective immediately upon posting on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Agreement.
